Making the Lives of Your Loved Ones Easier

Creating a will can be a process that conjures up a lot of emotion, as nobody wants to think about their own death. However, it is highly important – especially if you want to alleviate unnecessary problems for loved ones you leave behind. Not only does a will leave instructions about what to do with your estate after your death, but it can ensure that certain people get certain parts of your estate – especially items that are valuable or have sentimental value.

Problems that Arise when there is No Will

Dying without a will can create problems for those you leave behind when it comes to settling your estate, or choosing who will be looking after your children.

Settling Your Estate: Initially, your property will be divided according to the law, which may differ from how you would have wanted it divided. For example, if you separated from your wife years ago and were in a stable relationship at the time of your death but had no will, the Succession Law Reform Act of Ontario will determine that your legal spouse will receive the first $200,000 of your estate. Any children will inherit 2/3 and your legal spouse 1/3 of what is left over; your current partner may or may not be entitled to raise a claim for support from your estate. It’s even possible that depending on your situation when you die without a will (without any spouse, children or other family members), the government gets all of your estate.

Choosing a Guardian: Without a will, a guardian of your choice cannot be easily appointed for any dependants you have under the age of 18.

Time Delays without a Will

When someone does not have a will, there are time delays and expenses involved in trying to settle the estate. An estate trustee will be appointed by the court, which will normally be the closest relative. This may or may not be someone you are close to at the time of your death, or wish to take care of your estate!

Make Sure Have a Current, Valid Will

Don’t make your death even harder on your loved ones. Ensure you have a current, valid will at the time of your death. As well, be sure to review the document regularly to make any necessary changes; especially when your circumstances may have changed, such as getting married, having children,  or getting divorced.
